Randal S. Mashburn, shareholder in the Nashville office, concentrates his practice in mediation, bankruptcy, commercial litigation, debtor-creditor issues, workouts, and insolvency law. He has more than 25 years of experience involving a wide variety of litigation over contracts, lender liability, health care issues, fraud, director/officer liability, banking, business dissolutions, UCC issues, real estate and other types of commercial and financial matters. His experience includes the representation of plaintiffs, defendants, creditors, debtors, trustees, committees, examiners and receivers, as well as service himself as a court-appointed bankruptcy examiner and Chapter 11 trustee.

In the bankruptcy area, Randal's experience includes handling litigation over preferences, fraudulent transfers, stay relief, plan confirmation, executory contract issues and a wide variety of other insolvency-related matters. He also frequently advises clients in debt restructuring, asset sales and other debtor-creditor issues. Aside from bankruptcy matters, his litigation experience includes both trial and appellate matters in state courts throughout the Southeast and federal court throughout the country.

In addition to extensive experience as a litigator and bankruptcy advisor, a significant portion of his time is devoted to service as a mediator in a wide range of commercial, financial and business disputes. He has more than 200 hours of training in mediation and arbitration, is a Tennessee Supreme Court Rule 31 Listed Mediator and is a frequent speaker on the subject of alternative dispute resolution.
